Pension & Employee Benefits

For all businesses large and small, carefully structured pension and employee benefit plans are vital. Lourie & Cutler has extensive experience in designing and drafting these plans as well as dealing with their operational issues. We assist clients with:

  • Qualified retirement plans. Pensions, profit sharing and 401(k) plans are among the retirement plans we help design and tailor to the needs of clients. Our attorneys can draft plans for a client or work with prototype plan providers to customize such plans to the client's specific needs.
  • Nonqualified retirement and compensation plans. We frequently advise clients regarding executive compensation arrangements, deferred compensation plans, Rabbi trusts, and SERPs, and have extensive experience in crafting and implementing these types of arrangements. Our attorneys also regularly advise employers and executives on compliance with the highly complex Section 409A rules.
  • Other benefit plans. We advise employers on health and welfare plans. Our attorneys also are experienced in drafting cafeteria plans, which provide employees with flexible benefits and significant tax advantages.
  • Compliance. We are experienced in dealing with Internal Revenue Service and U.S. Department of Labor audits of qualified plans, and with issues involving Forms 5500, including resolution of late filing issues, and keeping plans up-to-date with changes in applicable law.

Once pension and employee benefit plans are established, Lourie & Cutler will assist clients with their maintenance and operation, and will also help implement plan terminations. We frequently represent law firms that do not have in-house expertise in this area.
